In reality, whether or not a valid Will exists, the estate of a deceased person in Cyprus must typically go through probate in order to be legally administered.
The Role of Probate
Probate is the legal procedure through which a Will is verified by the Courts and executors are formally granted the authority to deal with the deceased’s assets. This process ensures that all debts, taxes, and obligations are settled before distributing the remainder of the estate to the rightful beneficiaries.
In Cyprus, probate must be initiated in the District Court where the deceased was resident. The process involves submitting the Will (if one exists), the death certificate, a statement of assets, and various affidavits. The biggest administrative delay is income tax clearance, especially for those who are below the threshold and have not been filing tax returns. Once everything has been completed, the Court then issues a Grant of Probate or Letters of Administration, allowing the estate administration to proceed.

Why a Will Alone Isn’t Enough
The Will acts as a guiding document, specifying the wishes of the deceased and the law the Will should be administered under, but it must still be validated by the court. Without probate, banks, land registries and other institutions will not release or transfer the deceased’s assets.
