Owning property jointly in Cyprus and the UK involves navigating different legal systems, requiring clear co-ownership agreements and separate Wills.


Cyprus follows the equivalent of “tenancy in common” for married couples, while England & Wales have joint tenancy with automatic survivorship, so consulting competent advisors in both jurisdictions is crucial to define shares, manage expenses, plan for inheritance (avoiding conflicts between UK probate and Cypriot intestacy) and understand UK post-Brexit ownership rules as a non-EU national.

Legal Framework


Cyprus uses "tenancy in common", meaning each owner holds a specific share (e.g. 50/50, 70/30) of the property, not automatic joint tenancy and accordingly each share passes through their Will (and Probate) rather than passing to the survivor automatically.


Co-ownership Agreements


Essential for defining rights, responsibilities, contributions to expenses (maintenance, communal fees) and dispute resolution.


Marital Property


Cyprus follows a separate property regime, but a spouse can claim up to 50% of the property's increased value if they can prove financial or indirect (homemaking) contribution during divorce.


Post-Brexit for UK Citizens


UK citizens are treated as non-EU nationals, facing limits on land size and potential delays for acquisition permits.


Inheritance


To reiterate the first paragraph above, unlike the UK's right of survivorship, a deceased's share in Cyprus passes through their estate (Will or intestacy), making a Cypriot Will vital.

UK Property Ownership (England & Wales)


Joint Tenancy (JT)


Common for spouses/partners, where owners hold equal shares and the property automatically passes to the survivor(s) upon death.


Tenancy in Common (TIC)


For unequal shares or to avoid automatic survivorship, similar to Cyprus's system, with each owner's share passing via their Will.


Scotland


Scotland has a similar system, referred to as “pro indiviso”.
